United States Attorney General Jeff Sessions issued a warning to the city of Baltimore. He warned that the agreement the city of Baltimore was railroaded into under the Obama administration to overhaul the Baltimore police force will likely result in a significant decrease in safety in the city.

This warning was issued on the heels of  U.S. District Judge James Bredar approving the agreement in spite of significant and harshly worded objections from the Justice Department. Judge Bredar signed the so-called consent decree on Friday just one day after a hearing that was supposed to solicit comments from the local community regarding their thoughts on the plans. Obama appointee Judge Bredar determined the plan was “comprehensive, detailed and precise” despite significant and grave concerns expressed by the DOJ both at the hearing and in writing.

Sessions issued a statement on Friday regarding the Baltimore agreement stating it shows –

“…clear departures from many proven principles of good policing that we fear will result in more crime. The decree was negotiated during a rushed process by the previous administration and signed only days before they left office. While the Department of Justice continues to fully support police reform in Baltimore, I have grave concerns that some provisions of this decree will reduce the lawful powers of the police department and result in a less safe city.”

This plan is aimed at rooting out racist practices being conducted by the Baltimore police force. A federal investigation conducted during the Obama administration claimed to find rampant abuse by Baltimore police, including unlawful stops and use of excessive force against black people.

This investigation was prompted by the death of Freddie Gray in 2015. Gray was a 25-year-old black man arrested by the Baltimore Police Department for possessing what the police alleged was an illegal switchblade under Baltimore law. His neck was broken during a lurching ride in the back of a police van.  He had no seatbelt and his hands and legs shackled. Gray’s death touched off the worst rioting and civil unrest in Baltimore in decades.

In a memo made public, the Trump DOJ has stated that it may retreat from the consent decrees put into place under the Obama DOJ in many cities such as Cleveland, Ohio; Ferguson, Missouri; Miami; and Newark, New Jersey.

The homicide rate in Baltimore immediately spiked after the riots over Gray’s death and has not relented.  2017 has started no differently with 79 recorded homicides in the first 3 months of the year, as compared to 56 for the same period in the year prior.

Police Commissioner Kevin Davis and many other city officials have voiced their support for the agreement and Mayor Catherine Pugh has disputed the notion the decree will hurt the fight against crime.

Mayor Pugh states –

I believe that it makes Baltimore safer. I think by building and training our police officers in ways to de-escalate violence, to work with our communities, to have cultural diversity training and have the right kind of tools they need to know what they can do in certain areas of our community … I think it’s improved policing.”

Baltimore’s consent order calls for additional officer training, as well as strongly discouraging arrests for minor offenses such as traffic infractions or loitering.  The order also states officers can no longer detain someone simply for being present in a high crime area. Many police department reforms have also begun within the department as a result of Gray’s death, such as body cameras and updates to the use-of-force policy.

President of the Baltimore police union, Gene Ryan, complained that the agreement was rushed and the union wasn’t given the opportunity to be involved in the negotiations to any significant degree.  The national Fraternal Order of Police said it was disappointed by the judge’s decision to move forward.
