Ever since he took office, Barack Obama has been flirting with the Constitutional line with his actions, and in many cases far overstepped his authority. Well, a federal judge apparently thinks he’s been going too far, and she just smacked down one of Obama’s biggest legacy items.

On Thursday a federal judge came to a decision in the House of Representatives v. Burwell case, which was centered around Obama’s use of subsidies to reduce “deductibles, co-pays, and other means of ‘cost sharing’ by insurers.” U.S. District Court Judge Rosemary Collyer ruled against the subsidies, and said they “cannot” be funded the way that they currently are.

In Collyer’s opinion, the section doesn’t follow the letter of the law, which states that only Congress can appropriate funding for such subsidies.

“Congress is the only source for such an appropriation, and no public money can be spent without one.”

This fight actually started back under Speaker Boehner’s leadership when Republicans were trying to put his overreaches in check. The judge’s decision is a massive victory for the GOP, who has been trying to strip back provisions of the law since it was implemented, but faced veto threats from Obama if they were to pass any legislation doing so.

Odds are, Obama isn’t going to take the decision lying down, but at least for now, America scored a victory against the worst legislation to ever be signed into law.
