U.S. District Court Judge David Bunning ordered the Rowan County clerk to be released Tuesday on the condition that she not interfere with the issuance of marriage licenses in her office.

Plaintiffs who had sued the defiant county clerk asked the court to release Davis after her deputies issued marriage licenses to same-sex couples.

The judge agreed that the Rowan County Clerk’s Office was fulfilling its obligation to issue marriage licenses and ordered the county clerk released from jail.

Five of the six deputies in Davis’ office continued to issue marriage licenses to same-sex couples after Davis was jailed. The judge ordered them to continue doing so and provide status reports to the court every two weeks.
