Senator Rand Paul shared on the Fox Newschannel’s “Hannity,” that he was intent on suing Obama if he did not put an end to his NSA snooping program. Knowing that Obama doesn’t do anything he doesn’t want to do, Paul is officially suing Obama and began the process by filing the papers today.
Paul was said to submit the papers to the U.S. District Court in Washington, D.C this morning in regards to the National Security Agency’s massive surveillance programs. Paul has joined leagues with “FreedomWorks President Matt Kibbe and former Virginia Attorney General Ken Cuccinel,” in effort to stop the seemingly unstoppable administration.
The lawsuit not only lists Obama but the Director of National Intelligence, James Clapper, the Director of the National Security Agency, Keith Alexander and FBI Director, James Comey as well. It is said to ward off the government’s abuse regarding the, “Defendants’ mass, suspicionless, non-particularized collection, storage, retention, and search of telephone metadata related to every domestic or international phone call made or received by Plaintiffs and class members.”
Paul went on to explain the reasoning behind why he is taking such drastic measures. He says that since his, and America’s, requests have been ignored, “I am filing a lawsuit against President Barack Obama because he has publicly refused to stop a clear and continuing violation of the 4th Amendment.”
He then argues, “The Bill of Rights protects all citizens from general warrants. I expect this case to go all the way to the Supreme Court and I predict the American people will win.”
During the press conference immediately after having filed the class action lawsuit, Paul conveyed, “There’s a huge and growing swell of protest in this country of people who are outraged that their records are being taken without suspicion, without a judge’s warrant and without individualization.”
He further clarified his stance on the matter saying, “I’m not against the NSA, I’m not against spying, I’m not against looking at phone records. I just want you to go to a judge, have an individual’s name and [get] a warrant. That’s what the Fourth Amendment says.”
He also relayed that there has been “no evidence” to suggest that the NSA snooping program has contributed to the prevention of a major terrorist attack.
Cuccinelli soon took the mic where he explained the true intentions of the lawsuit saying, “This case is, first of all, the only case that is strictly challenging the Fourth Amendment elements of the telephone metadata gathering. Second of all, this will be certified later in the case as a class action, on behalf of all Americans. The other cases thus far are on behalf of individual plaintiffs … that does not provide relief for every American using telephones. This case will.”
