Current law requires nominees for secretary of defense to have spent at least seven years out of uniform, Mattis, a former commander of U.S. Central Command, retired in 2013, fewer than four years ago.

48 hours before general Mattis’s confirmation hearing before the Senate Armed Services Committee, lawmakers on the panel met to discuss the importance of civilian control of the military and the implications of confirming Mattis.

Democrat from New York, Sen. Kirsten Gillibrand, oppose a waiver that would allow Mattis, to serve in the position despite a law that requires the defense secretary to have been out of the military for at least seven years before assuming the role.

Gillibrand has made it clear that she and the other democratic party members oppose the waiver, though she declined to give out their names.

When Gillibrand met with the party members and General Mattis behind closed doors, she discussed women in the military and the importance equality.  Gillibrand went into details about the who passed Army Ranger school and how admirable and inspiring those women are, and really highlighted some of the studies about how effective women are in combat in the military, which skills they bring to the table that are unique and different and really valuable.

Sen. Richard Blumenthal, Connecticut Democrat, also came out and stated he opposes the waiver needed for Mattis. Blumenthal stated he was worried it would set a precedence to constitutional law. To pass the waiver, only 60 of the 100 members of the Senate must approve the measure.
