Jay Angoff, the former head of the HHS Office of Consumer Information and Insurance Oversight, is suing the Obama Administration for lack of transparency over the cost of premiums for the next year. Angoff’s job was to lead the effort in implementing Obamacare. It is interesting that a former official of an administration that claims to be the most transparent is being sued for not being transparent.

The man who used to be in charge of implementing Obamacare has launched a lawsuit seeking to solve a big secret of its upcoming open-enrollment period: what insurers propose to charge customers in premiums next year.

The suit charges that the Department of Health and Human Services is violating the Affordable Care Act by not yet revealing those proposed rates, despite the fact that 2015 plans go on sale Nov. 15 on government-run exchanges, including the federally run HealthCare.gov.

The action was filed Tuesday in federal court in Missouri by Washington, D.C., attorney Jay Angoff, who in 2010 was head of the HHS Office of Consumer Information and Insurance Oversight—the office responsible for implementing the ACA. Angoff also served as a senior advisor to former HHS Secretary Kathleen Sebelius.

“We’re not opponents of the ACA, we’re supporters of the ACA,” Angoff said of himself and his clients, the Consumers Council of Missouri, a public interest nonprofit group. “We’re not haters of HHS, we’re lovers of HHS.”

“But this is tough love,” he quipped about the lawsuit, which was reported earlier Wednesday by The Washington Post.

Here, via the House Energy and Commerce Committee, is the reaction from the House on the lawsuit.

In February 2013, President Obama boasted that his was “the most transparent administration in history,” but the administration’s actions have failed to match the rhetoric. The latest blow against the president’s claims came this week as a former Obama official filed a lawsuit against the administration for not disclosing health care premiums under the president’s health care law. CNBC reports, “The man who used to be in charge of implementing Obamacare has launched a lawsuit seeking to solve a big secret of its upcoming open-enrollment period: what insurers propose to charge customers in premiums next year.” Delays and a lack of transparency have been commonplace throughout the implementation of this law. The administration has already delayed the start of the second open enrollment period to November 15, 2014, yet the exchange is still incomplete and premiums are still not publicly available. One year later, but not much has changed.

People all over the political spectrum are starting to see this administration for what it is. While it will not change anything, it does show no administration should go this far.
