Man Burns Flag And Brags About It On Facebook… Now THIS Is Happening To Him

When courts contradict each other, it is the people that lose.  Bryton Mellott, of Urbana, IL became an internet sensation within seconds of posting a photo of himself burning the American Flag on his Facebook page on July 3, 2016.  Though his internet notoriety was clearly not of any positive nature.

Along with the photo, Mellott posted, he also posted a message —

“I would like to one day feel a sense of pride toward my nationality again. But too little progress has been made. Too many people still suffer at the hands of politicians influenced by special interests. too many people are still being killed and brutalized by a police force plagued with authority complexes and racism. Too many people are allowed to be slaughtered for the sale of gun manufacturer profits. Too many Americans hold hate in their hearts in the name of their religion, and for fear of others. …. I do not have pride in my country. I am overwhelmingly ashamed, and I will demonstrate my feelings accordingly. #ArrestMe.”

Mellott was subsequently arrested for flag desecration, a class four felony in Illinois, as well as disorderly conduct. He was later released as the state’s attorney acknowledged that Illinois state law contradicts the Supreme Court ruling on this case.

Texas v. Johnson affirmed that burning the flag is indeed protected under the 1st amendment right to free speech.  The Supreme Court reaffirmed it under the United States v. Eichman. According to the highest court in the nation – burning the American flag is considered a protected form of free speech.  Now that being said, the adage still holds true — just because you CAN does not mean you SHOULD.

Frankly, I think burning the flag incites such strong emotions of anger in so many because of all that the American flag represents to so many people that the message, regardless of how valid it may be, gets lost in the process.  People simply do not hear what you have to say when the act you have committed is so egregious to them that all they can feel is anger at the symbolism that is being desecrated by the act.
