Florida Soldier’s Home Is Stolen While Fighting Terrorists

Michael Sharkey deployed with his Army unit to Afghanistan 2 years ago.  But he recently learned his home in New Port Richey, Florida, is occupied by squatters, Julio Ortiz, Fatima Cardoso and several pit bull dogs.

Complicated situation

But this is not a simple matter of trespassing.  Speaking with a member of the Pasco County Sheriff’s Department, who wished to remain anonymous, the story is much more complicated. ‘There is little the Sheriff’s department can do to assist Sharkey under criminal statutes.  It is a civil matter to be decided by the courts, not a criminal matter.  A court order of eviction must be obtained and served to remove Ortiz and Cardoso.’

Before deploying, Soldier Sharkey and wife Danielle asked friend Lisa Pettus to watch over the house and property during their absence.  Knowing the home needed repairs and other work, Sharkey granted Ms. Pettus access and authorization for this purpose.  Ms. Pettus was introduced by Ortiz through another friend and acknowledges hiring Ortiz to ‘fix up’ the home during Sharkey’s absence.   Two months after the ‘fix up’ was complete, Pettus checked on the home only to find Ortiz and Cardoso living in the home.

Squatters have NO rights, but there is ‘adverse possession’.  Florida statutes referencing adverse possession  were revised in 2011.   While the new statute has met with mixed reaction, claims under  adverse possession require occupancy/use for 7 years and payment of all taxes during the time period.  Neither apply in Sharkey’s case.

Sharkey’s wife Danielle, Pettus and a Pasco County Sheriff’s Deputy visited the home to evict Ortiz.  But Ortiz claimed he has an oral agreement with Pettus to live in the home.  Oral agreements are valid under Florida law, but difficult, if not impossible,  to enforce.  Neither Pettus nor Sharkey acknowledge any such agreement.

It’s unclear how long Ortiz had been occupying the home.  But by all appearances he has established residency.  Ortiz has electric power and receives mail at the location.  With residency, Ortiz becomes a tenant, complicating this matter further with Florida landlord/tenant laws.

There are 2 important lessons here.  First, be very careful who you ask to be a caretaker in your absence.  And two, always, ALWAYS hire licensed contractors for all home repairs.   Trading rent for home repairs rarely works to anyone’s benefit.

Sharkey’s dilemma has garnered national attention.  Ortiz and Cardosa, both convicted felons having served time for robbery, car jacking and drug charges,  seem unwilling to push their luck further.   Local television station WFLA reported Thursday evening most of Ortiz and Cardoso’s possession were gone from the home and the couple had vacated the premises.  Leaving behind only a few pieces of furniture and  2 dogs, the Sharkey’s now once again have possession of their home.
