Just as I posted an article about Justice Scalia’s take on religion and the Constitution, another religious freedom issue pops up, and it’s right in my backyard. In this case, a Peoria, Ariz., teacher was told to remove her bible from the classroom after a complaint by an atheist organization.

And after the “Freedom From Religion” foundation complained about the teacher’s bible, the Scottsdale-based Alliance Defending Freedom shot back, warning the district of “overreach.”

Bibles and other religious symbols are generally permitted, as long as they are within “personal spaces.” A U.S. District court in Texas ruled as such:

Items on a teacher’s desk often include such as things a family photos and mementos. Having a small cross, which oftentimes is simply a gift from a student, alongside family photos or other student gifts, clearly does not demonstrate government endorsement. The mere fact that it occurs in a government setting does not render it unconstitutional.

In Ohio, the courts ruled that a teacher may display a bible on their desk because it is their “personal space.” From the ruling:

The Free Exercise Clause protected Freshwater’s conduct as to his personal Bible. “When the district asked Freshwater to remove his Bible from his desk, it was not asking him to cease a meaningless activity. It was demanding that he give up his constitutionally guaranteed rights. The government can encroach upon constitutional rights, but it must have a legitimate reason for doing so. Here, the district’s reason was not legitimate. The district feared an Establishment Clause violation where none existed. Unsubstantiated fear alone cannot justify flouting the First Amendment.

Courts HAVE ruled that religious symbols can not be displayed in a classroom in a way that demonstrates endorsement or “indoctrination” (unless it’s a class on religion). But crosses and Stars of David are permitted around the neck.

In the case here in Peoria, the allegations are that the Bibles were not in personal spaces. But the Christian group Alliance Defending Freedom (ADF) says teachers were told all religious items must be removed from personal spaces.

“We were notified that the district had overreached,” ADF attorney Jeremy Tedesco said Friday. “As we unfortunately see in these circumstances, the schools overreact and restrict more than is necessary. It’s the search-and-destroy separation of church and state we see from secular groups like Freedom From Religion, and it’s not the actual state of the law. Schools need to respect the constitutional rights of the teacher and students.”

The school district said if there was a letter or dictate that teachers remove religious items, it didn’t come from them.
