A learning disabled, 8-year-old little boy was removed from his 3rd-grade classroom at Hillsboro Elementary  in Jefferson County, Missouri on September 8.  He was served with a restraining order by a Deputy Sheriff.

According to his mother, Peyton Whitehead is not allowed to return to school.  At this point, he’s not even allowed to leave his home without the threat of arrest as the restraining order does not allow Peyton to be within 1,000 feet of the children who live on the same block as his own home located just outside the town of Hillsboro.

The father of the children who filed the restraining order claims that Peyton has made threatening statements towards his children.

According to both parents, the neighbors have been feuding.  This seems to be how the father chose to address the most recent altercation.

Rather than being an adult and handling as such, he chose to attack a child, deprive said child of his education thus causing Peyton’s family financial hardship, and essentially make Peyton a prisoner in his own home. Add to all of that, Peyton has a learning disability which means he likely has an IEP or Individual Education Plan to assist him with the additional educational needs that he may have.  That means that he is not receiving any of those services that he may very well NEED.

According to Local News 4 – they asked the Jefferson County Sheriff’s Department why deputies didn’t serve the court papers after Peyton got home to avoid the embarrassment of being removed from school in front of his classmates. Detective Sergeant James Kausler explained that deputies are required to act when they get orders from a judge.

Statutorily we’re required to carry out the judge’s order and that was, at that point, to remove him from school,” said Kausler.

Peyton’s mother is not able to work and is being forced to homeschool her son until a court appearance on September 20 to resolve this matter.
