[WATCH!] DOJ’s New ‘Profiling’ Guidance Adds ‘Off-Limits’ Categories For Feds!

The U.S. Department of Justice (DOJ) has just released new guidance for federal law enforcement officers on “profiling.”

Now, the categories of gender, national origin, religion, sexual orientation, and gender identity are added to the current ban on racial profiling.

According to the DOJ, their new document:

“…builds upon and expands the framework of the 2003 Guidance, and it reaffirms the Federal government’s deep commitment to ensuring that its law enforcement agencies conduct their activities in an unbiased manner.

Biased practices, as the Federal government has long recognized, are unfair, promote mistrust of law enforcement, and perpetuate negative and harmful stereotypes.

Moreover—and vitally important—biased practices are ineffective.”

While it may seem daunting, in some ways, the 11-page document expresses what should be common sense.

For example, if a federal officer (or local police officer participating in a federal law enforcement task) is watching a number of cars speed by, the officer can’t use the prohibited criteria to decide which car to pull over.

But, if they have a “be on the lookout” report for a suspect of a particular race, national origin, or gender, they can use that criteria to pull over a certain car.

And if officers have information that a murder was committed by a gang whose members are exclusively part of one religion or race, officers can use that information to profile suspects.

In a statement explaining the reasons for the new guidance, soon-to-be-retired Attorney General Eric Holder commented that:

“Profiling by law enforcement is not only wrong, it is profoundly misguided and ineffective.

Particularly in light of certain recent incidents we’ve seen at the local level, and the widespread concerns about trust in the criminal justice process, it’s imperative that we take every possible action to institute strong and sound policing practices.”

Like most federal government rules, there also are requirements for training and data collection – to be paid for with taxpayer money, of course – to go along with it.
